B&S International B.V. and its subsidiaries and affiliated entities (collectively, “B&S,” “we,” or “us”) respect your privacy and are committed to protecting your personal data. This Candidate Privacy Notice (“Notice”) explains how we collect, use, and share your Personal Data when you apply for a job or participate in an event with us. It also informs you about your rights and choices regarding your personal data and how you can contact us if you have any questions or concerns.
This Notice needs to be read in conjunction with the B&S Privacy Policy which can be found at Privacy Policy | B&S (bs-group-sa.com).

Personal Data means any information that (either in isolation or in combination with other information) enables you to be directly or indirectly identified (“Personal Data”). We are the “controller” of the personal data you provide us and will process any such Personal Data in accordance with applicable laws and the terms in this Notice.

If you receive an offer of employment and accept employment with us, your Personal Data will be processed pursuant to our internal Privacy Policy.

We may update this Notice from time to time. We will revise the “last updated” date at the top of this Notice when we do.

1. How do we collect your Personal Data and what Personal Data do we collect?

We collect your Personal Data from various sources, such as:

  • Yourself, when you submit your application, resume, and other accompanying information to B&S, either directly through our website Home | B&S Careers (bs-group-sa.com) or indirectly through third parties, e.g., recruitment agencies, job boards, or social and professional networks;
  • Publicly accessible sources, such as social and professional networks;
  • Referrals from B&S employees;
  • Your named references;
  • CCTV at out (office) locations;
  • Background check service providers (if we extend a conditional offer of employment).

We may collect the following Personal Data:

  • Contact information, including name, address, email and phone numbers;
  • Identification information, including a Identification documents or Personal identifiers (i.e. copy passport, passport number, copy ID, ID number, SSN, social insurance, national insurance), date of birth, signature, gender.
  • Application information, including resume, education, degrees, skills & training history, qualifications/certifications, languages, employment information/ work history, professional experience & affiliations, job application details (e.g., application form, interview notes, references), salary/wage expectation, start date, right to work/work authorization.

Sensitive Data that might be collected (where required and permitted by law) include:

  • Nationality, criminal record data (in the form of a Certificate of Conduct, if applicable in the specific country), health related information, immigration status.

If you choose not to provide mandatory Personal Data when requested and the Personal Data is necessary for us to evaluate your application we may not be able to process your application further.

We process your Personal Data for the following purposes and legal bases:

  • To assess your skills, qualifications, and interests against our job opening requirements. The legal basis for this processing is our legitimate interest as your prospective employer and the necessity for taking steps at your request prior to entering into a contract with you.
  • To verify the information you provide us during the application process and conduct reference checks and (criminal) background checks (where applicable) if you are offered a job. The legal basis for this processing is our legitimate interest as your prospective employer and the necessity for taking steps at your request prior to entering into a contract with you.
  • To communicate with you about your application/s and the recruitment process. The legal basis for this processing is our legitimate interest as your prospective employer and the necessity for taking steps at your request prior to entering into a contract with you.
  • To inform you about other potential job opportunities. The legal basis for this processing is your consent, which you can withdraw at any time by contacting us.
  • To assess your eligibility for hiring. The legal basis for this processing is our legitimate interest as your prospective employer and the necessity for taking steps at your request prior to entering into a contract with you.
  • To provide you with assistance obtaining an immigration visa or work permit, when necessary and requested by you. The legal basis for this processing is the necessity for taking steps at your request prior to entering into a contract with you.
  • To deal with expenses incurred by you, to the extent these expenses are eligible for reimbursement. The legal basis for this processing is our legitimate interest as your prospective employer.
  • To initiate the onboarding procedures to sign and enter into an employment agreement with you. The legal basis for this processing is the necessity for taking steps at your request prior to entering into a contract with you.
  • To comply with applicable laws (e.g., labor and employment, health and safety, tax, immigration, ESG, human rights and anti-discrimination laws), regulations, or legal requirements, including the completion of any reports required by law. The legal basis for this processing is the necessity for compliance with a legal obligation to which we are subject.
  • To maintain the internal integrity, access control and security of our company, office premises and websites. The legal basis for this processing is our legitimate interest.
  • To use the information in connection with any legal proceedings (including prospective legal proceedings), to comply with laws and regulations, obtaining legal advice, establishing, or defending legal claims, or otherwise where it’s strictly necessary for the administration of justice in accordance with applicable laws. The legal basis for this processing is the necessity for the establishment, exercise or defense of legal claims or whenever courts are acting in their judicial capacity.
  • To process certain types of sensitive Personal Data in limited circumstances where we must protect your interests, where we need to do so to comply with specific legal obligations (e.g., equal opportunity, anti-discrimination, social security, human rights or employment law), or where we have your explicit consent to use it. The legal basis for this processing is your explicit consent, which you can withdraw at any time by contacting us, or the necessity for compliance with a legal obligation to which we are subject or the necessity for the establishment, exercise or defense of legal claims or whenever courts are acting in their judicial capacity.

We do not sell or share any Personal Data you provide to us through the employment application process for any form of consideration.

3. Who do we share your Personal Data with?

We may share your Personal Data with the following recipients:

  • Our employees who need to access your Personal Data for the purposes described in this Notice, such as HR, Recruiters, hiring managers and other people involved in the hiring process.
  • Our subsidiaries and affiliates, who may be involved in the hiring process or have job opportunities that match your profile.
  • Our third-party service providers, who help us with our recruitment and hiring activities, such as Smartrecruiters, our applicant onboarding system provider, and background check service providers.
  • Other third parties, such as law enforcement authorities, regulators, courts, or other public authorities, if we are required or permitted to do so by law, or if we need to protect our rights or interests or those of others.

We will only share your Personal Data with the recipients pursuant to the terms of this Notice, when otherwise required by applicable law, or with your consent. We will obtain assurances from each recipient with whom we share your Personal Data that they will safeguard your Personal Data in a manner consistent with this Notice.

4. How do we protect your Personal Data?

We are committed to protecting your Personal Data. We use various technical and organizational measures to protect your Personal Data from loss, misuse, unauthorized access, disclosure, alteration, and destruction. This includes having comprehensive security policies and procedures in place, performing regular information security risk assessments, and requiring our employees to undergo regular information security awareness training.

5. How long do we retain your Personal Data?

We do not retain your Personal Data for longer than necessary to fulfil the purposes described in this Notice.
If you are unsuccessful in your application, or you have withdrawn yourself from the application, please note that your Personal Data is automatically deleted within 2 months. If you have given your consent, your Personal Data will be deleted after an extended period of 12 months so that we can keep you in mind for future vacancies (unless you chose to again extend that period). If you were successful in your application and join one of our companies, your Personal Data will become part of your personnel file and will be kept in line with the applicable retention periods.

If your Personal Data is collected through other sources than directly from yourself, your Personal Data will be uploaded in the recruitment system of which you will receive a notification by email. In this notification you are requested to provide your consent with a link to the created profile which you can review. Should you not provide this consent within 30 days, your Personal Data will automatically be deleted.

6. How do we transfer your Personal Data internationally?

In principle, Personal Data you submit as part of your application will be stored and processed by us or our third-party service providers in the EEA. If circumstances occur which requires us to transfer your Personal Data outside the EEA, for the purposes of managing your application and the hiring process, we will do so in a secure manner. We will always protect your Personal Data pursuant to this Notice wherever it is processed.

When B&S engages in transfers of Personal Data to third countries, it relies on:

  • Adequacy Decisions, as adopted by the European Commission, based on Article 45 of Regulation (EU) 2016/679 (GDPR)
  • Standard Contractual Clauses, as issued by the European Commission
  • Data Processing Agreements (as provided under applicable specific regulations) and/or other transfer mechanisms, as provided by the applicable regulations.

7. What are your rights with respect to your Personal Data?

Depending on the applicable laws in your jurisdiction, you may have the following rights:

  • The right to be informed: You have the right to be informed about the processing of your Personal Data. This Notice, along with our Privacy Policy, provides you with this information. Should you require further information, you can submit this request to us.
  • The right of access: You have the right to request whether we process your Personal Data and if this is the case, the right to access your Personal Data and the right to receive certain information about the processing of your Personal Data.
  • The right to rectification: If you believe that your Personal Data is incorrect or incomplete, you can request that your Personal Data be supplemented or amended. Please ensure yourself too, that the information you submit, where you have control over, is kept accurate.
  • The right of erasure: In certain situations, you have the right to have your Personal Data erased. This is the case, for example, if the Personal Data has been processed in violation with applicable laws or if the personal data are no longer necessary for the purpose for which they were collected.
  • Right to restrict processing: You have the right to have the processing of your Personal Data restricted. This means that we will suspend the processing of your Personal Data for a certain period of time. Circumstances giving rise to this include, for example, situations where you question the accuracy of the data, or because you consider that the Personal Data is no longer necessary for the purpose for which it was collected and kept. This right does not prevent us from continuing to process your Personal Data. We will let you know when the restriction is lifted.
  • Right to data portability: You may request to hand over Personal Data we keep about you in certain cases in a structured, common and machine-readable form.
  • Right to withdraw your consent: Where data processing is based on your consent, you have the right to withdraw the consent granted at any time. Upon receipt of your request, we will stop the processing of your personal data for which you had granted consent. However, withdrawing consent does not affect the lawfulness of the processing prior to your withdrawal.
  • Please note that in some cases your rights are not absolute and we may not be obliged to comply with your request. We will always assess whether to give effect to this on a case-by-case basis and will inform you accordingly.
  • Right to object: You have the right to object to the processing of your Personal Data.
  • The right not to be subject to automated decision-making: This includes the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you, unless it is necessary for entering into, or performing, a contract with you, or is authorized by law and subject to appropriate safeguards for your rights and freedoms, or is based on your explicit consent. (Please note that at the time being we do not make use of automated decision-making).

To verify your identity, we will ask you to provide us with proof of your identity. If this is a copy of any identity card with a (passport) photo and personal identification number (BSN), please have these masked. Once we have verified your identity, we will delete the copy.

If you believe that your rights have been violated, you can also file a complaint with the relevant data protection authority. The Data Protection Authority of the Netherlands, where B&S International is located, is the “Autoriteit Persoonsgegevens” Home | Autoriteit Persoonsgegevens. If you live or intent to work in another country, you can file a complaint with the supervisory authority in that country, where applicable.
